These Terms & Conditions govern your use of the Castilan Watches website and purchases made through our online store. Please read them together with our Shipping Policy, Refund & Returns Policy, Warranty, Privacy Policy, Legal Notice and No Brand Affiliation policy.
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law (ACL). If these Terms conflict with a non-excludable right under the ACL, the ACL prevails.

2. Acceptance of these Terms
By using our website or placing an order, you agree to these Terms to the extent they apply to your use or purchase. If you are under 18, you should use the store and place orders only with the involvement of a parent or legal guardian who has capacity to enter into the transaction.
3. Products and product information
We sell watches and related products to customers in Australia. Some products may be sourced from overseas manufacturers, suppliers or fulfilment partners and may be shipped directly to you by a fulfilment partner.
We aim to ensure that product descriptions, specifications, photographs, prices and availability information are accurate and not misleading. Product specifications such as movement type, crystal material, case material, dimensions and water-resistance rating apply only where stated for that specific model.
Images are provided to help identify and illustrate products. Minor differences caused by screen settings, photography or normal manufacturing tolerances may occur, but products will remain subject to the descriptions, representations and consumer guarantees that apply under Australian law.
Third-party brand names and trade marks remain the property of their respective owners. Unless expressly stated otherwise, we are an independent retailer and are not affiliated with, sponsored by, endorsed by or licensed by third-party watch brands. 4. Prices and currency
All prices are displayed in Australian Dollars (AUD). Applicable taxes, duties and unavoidable or pre-selected charges will be included in the total price as required by Australian law. Any optional charges will be disclosed before you complete your purchase.
We may change prices for future orders at any time. A price change does not alter the price of an order that has already been accepted, except where a correction is required by law or you agree to the change.
If more than one price is displayed for the same product, or a displayed price is incorrect, we will deal with the issue in accordance with applicable Australian law. We may temporarily stop selling the affected product while a pricing error is corrected.
5. Placing an order and order acceptance
When you submit an order, you are offering to purchase the products in that order. An automated order acknowledgement confirms that we received the order but does not necessarily mean that the order has been accepted.
Unless we expressly state otherwise, we accept an order when we send you a dispatch confirmation or otherwise expressly confirm acceptance. Before acceptance, we may reject an order for a legitimate reason such as unavailable stock, inability to deliver to the address provided, payment failure, suspected fraud or a genuine and obvious website error.
If we have taken payment for an order that we do not accept or cannot supply, we will provide an appropriate solution, including a refund where required. We will not accept payment where we know, or should know, that we cannot supply the product by the promised date or within a reasonable time.
6. Payment
You must pay the total amount shown at checkout using one of the payment methods we make available. You confirm that you are authorised to use the selected payment method and that the information you provide is accurate.
Payments may be processed by Shopify Payments or other third-party payment providers. Those providers may apply their own terms and privacy practices. We may use reasonable fraud-prevention or payment-risk checks before accepting or dispatching an order.
7. Stock, sourcing and fulfilment
We may not physically hold every product offered on the website. Some orders may be fulfilled by overseas suppliers or fulfilment partners. We aim to provide clear information about stock availability, sourcing and expected delivery times.
If a product becomes unavailable after you order, we will contact you and provide an appropriate solution. We will not substitute a materially different product without your agreement.
8. Shipping and delivery
Shipping, processing times, estimated delivery times, tracking, delayed shipments, lost orders and address issues are governed by our Shipping Policy.
Delivery dates are estimates unless we expressly guarantee a particular date. If we cannot supply an order within an agreed or reasonable timeframe, we will work with you to provide an appropriate solution as required by law.
9. Customer-requested cancellations
If you want to cancel an order before it has been dispatched, contact us as soon as possible. We will try to accommodate the request, but cancellation may not be possible once processing or fulfilment has progressed. If the order has already been dispatched, our Refund & Returns Policy will apply.
Nothing in this section limits any cancellation, refund or other remedy you may have under the Australian Consumer Law.
10. Returns, refunds and change of mind
Returns and refunds are governed by our Refund & Returns Policy. Our 30-day change-of-mind return policy is a voluntary benefit and is separate from your rights under the Australian Consumer Law.
If a product fails to meet a consumer guarantee, the remedy available depends on the nature and seriousness of the problem. A major failure may entitle you to choose a refund or replacement. For a problem that is not a major failure, we may be entitled to repair the product within a reasonable time before other remedies become available.
11. Warranty and Australian Consumer Law
We provide the voluntary warranty described in our Warranty Policy. That warranty is additional to, and does not replace or limit, rights and remedies under the Australian Consumer Law. Consumer guarantee rights may continue for a reasonable period after a voluntary warranty has expired, depending on the product and circumstances.
We are responsible for resolving remedies that the Australian Consumer Law requires us, as the seller, to provide. We will not require you to deal only with a manufacturer or overseas supplier in order to exercise rights you have against us under the ACL.
12. Promotions, discount codes and offers
Promotions, discount codes, giveaways or special offers may be subject to additional conditions stated with the promotion, including eligibility, validity dates, product exclusions or usage limits. Specific promotional conditions apply to that promotion, subject always to applicable law.
We may refuse or cancel the use of a promotion where there is genuine fraud, abuse, duplication or a clear breach of the stated promotional conditions. We will not use promotional terms to remove rights that cannot lawfully be excluded.
13. Website use
You must not use the website to engage in fraud, interfere with the website or its security, introduce malicious code, attempt unauthorised access, scrape or misuse content in a way that infringes rights, or use the website for an unlawful purpose.
We may take reasonable steps to protect the website, customers and our legitimate business interests where misuse or security risks are detected.
14. Intellectual property
Unless otherwise stated, original text, branding, logos and other content created by Castilan Watches are owned by or licensed to us. Third-party content remains subject to the rights of its respective owner. See our Legal Notice for further information.
You may view and use website content for personal, non-commercial shopping purposes. You must not reproduce, distribute, sell or commercially exploit our original content without permission, except where permitted by law.
15. Third-party services and links
Our website may use or link to third-party services, including payment providers, ecommerce services, analytics providers, social platforms and shipping carriers. We are not responsible for the independent content or practices of third-party websites that we do not control. This section does not limit any responsibility we have for products or services we sell to you, or any right that cannot lawfully be excluded.
16. Privacy
Our handling of personal information is described in our Privacy Policy. By using the website or placing an order, you acknowledge that personal information will be handled as described in that policy and any collection notices presented to you.
17. Liability and non-excludable rights
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right to compensation for reasonably foreseeable loss or damage, or other right or remedy that cannot lawfully be excluded under the Australian Consumer Law or other applicable law.
To the extent a liability can lawfully be limited, any limitation will apply only to the extent permitted by law. These Terms do not make you responsible for loss or damage caused by our breach of law, negligence or failure to comply with a non-excludable obligation.
18. Changes to these Terms
We may update these Terms from time to time. Updated Terms apply from the date they are published to future website use and future purchases. Changes will not reduce or remove rights that arose from an order accepted before the update or rights that cannot lawfully be excluded.
19. Governing law
These Terms and purchases made through the website are governed by the applicable laws of Australia and the laws of Queensland. Nothing in this section prevents you from relying on rights or protections that apply to you under mandatory Australian law.
20. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions continue to operate to the extent permitted by law. Any invalid provision will be read down only to the extent necessary to make it lawful and enforceable where that is legally possible.
